Terms & Conditions

Please read all these terms and conditions carefully.

Application

These Terms and Conditions apply to the purchase of services and any associated goods by you (the Customer or "you"). We are Sarah Diedro Jordão, trading as But What If You Thrive, located in Lisbon, Portugal (the Supplier, "us", "we", or "our").

By ordering any of the Services from our website, you agree to be bound by these Terms and Conditions. You may only purchase Services if you are eligible to enter into a contract and are at least 18 years old.

Interpretation

  • Consumer means an individual acting for purposes wholly or mainly outside their trade, business, craft or profession.

  • Contract means the legally binding agreement between you and us for the supply of Services.

  • Delivery Location means the online or physical location where Services are supplied, as set out in the Order.

  • Durable Medium means email or other medium allowing information to be retained for future reference.

  • Goods means any goods we supply alongside the Services.

  • Order means your request for Services submitted via our Website.

  • Privacy Policy means the terms which set out how we use personal information collected through the Website.

  • Services means any services advertised on our Website, including coaching, programs, or downloads.

  • Website means www.butwhatifyouthrive.com.

Services

Descriptions of Services and any Goods are listed on the Website. While we aim for accuracy, descriptions are illustrative only and may vary slightly.

You are responsible for ensuring that any custom requirements you provide are accurate. Services are subject to availability and may be updated to comply with legal or safety obligations. We will notify you of any such changes.

 

Customer Responsibilities

You agree to:

  • Provide accurate and complete information

  • Cooperate with us for service delivery

  • Obtain any required permissions or consents

Failure to do so may result in suspension or termination of the Contract.

 Personal Information

We process personal data in accordance with our Privacy Policy.
We may contact you via email or other electronic communication.

 

Basis of Sale

The display of Services on the Website is not a contractual offer. A Contract is formed only once we confirm your Order via email (Order Confirmation).

You are responsible for checking that your Order is correct before submitting. Any price estimates are valid for 7 days unless otherwise stated.

The Contract applies only to Consumers. If you are ordering as a business, please inform us so alternative terms can be arranged.

 

Fees and Payment

  • All prices and fees are as shown on the Website or otherwise confirmed in writing

  • Fees include VAT (if applicable)

  • You must pay using a valid method (credit card, debit card, etc.) when placing the Order

  • We may charge for additional services or materials upon mutual agreement

 

Delivery

Services will be delivered:

  • Online via Zoom or other digital platforms, or

  • Via digital downloads or email, or

  • In person (if explicitly arranged)

We aim to provide services within a reasonable timeframe. Delays beyond our control may entitle you to cancel or receive a refund where appropriate.

Withdrawal and Cancellation

You have a right to cancel within 14 days of entering into the Contract, unless:

  • Services have already been fully provided at your request

  • Digital content has been accessed or downloaded

  • The Service is personalized (e.g. tailored coaching sessions)

To cancel, email hello@butwhatifyouthrive.com clearly stating your decision. We will refund payments within 14 days of cancellation, unless exceptions apply as noted above.

If you request that Services begin within the 14-day cancellation period, you agree to pay for services already provided before cancellation.

 

Right to Cancel – Summary

You can cancel this contract within 14 days of Order Confirmation unless services have been performed or digital products accessed. We may withhold reimbursement until services or goods are returned or proven cancelled.

 

Conformity and Guarantee

We guarantee that:

  • Services will be delivered with reasonable care and skill

  • Any goods provided will match the description, be of satisfactory quality, and fit for their intended purpose

You must inform us promptly of any issue. Any warranties provided by third parties (e.g. platforms or tools) will be passed to you where applicable.

 

Duration, Termination and Suspension

The Contract continues until the Services have been completed, unless terminated earlier.

Either party may terminate the Contract if:

  • The other commits a serious breach and fails to fix it within 30 days

  • The other party is declared insolvent or bankrupt

Termination does not affect any rights accrued up to that point.

 

Force Majeure

We are not liable for delays caused by circumstances beyond our reasonable control (e.g. illness, natural disasters, internet failure). In such cases, we will notify you and make reasonable arrangements to resume or reschedule the Services.

 

Privacy

We process your data according to the General Data Protection Regulation (GDPR) and Portuguese data protection laws. For more details, please refer to our Privacy Policy.

Excluding Liability

We do not exclude liability for:

Death or personal injury caused by negligence

Fraud or fraudulent misrepresentation

Any other liability that cannot be excluded under applicable law

Subject to the above, we are not liable for:

Indirect or consequential losses

Loss of business, profits, or data

Service interruptions due to third-party tools/platforms (e.g. Zoom)

  

Governing Law and Disputes

These Terms are governed by the laws of Portugal. Any disputes will be resolved in the courts of Lisbon, unless otherwise required under EU consumer law.

We aim to resolve complaints amicably. Please contact hello@butwhatifyouthrive.com and we will respond within 5 working days.
